Social Networking Sites Original post: Wed 10/19/2011 at 7:42 PM

Social networking sites use disruptive technology to run their businesses. Each social networking site is trying to develop the new “it” technology that will render its competition obsolete.

The main business challenge facing social networking sites is that there is no clear way to assign a value to them. Competition is fierce in the social networking world because there are so many sites trying to compete. New technology is developed everyday; therefore, a social networking site can literally become outdated overnight.

Social networking sites consist of five main characteristics. Social networking site are user based, because individuals are able to contribute and organize information. Social networking sites are interactive, because they allow users to connect with each other. Social networking sites are community driven, because their members typically share something in common. Social networking sites revolve around the number of relationships formed between members. Social networking sites make it possible for users to share/communicate emotional content.

Social networking sites are susceptible to security breaches; therefore, each user’s information may become visible to an outside party. Constant communication can have unintended consequences. Your house may be robbed while you are on vacation because the wrong person happened to see your tweet about being out of town for a week. Social networking sites are linked to viruses and spam mail. Social networking sites have become an outlet for bullies and stalkers.

Mobile applications are currently the biggest trend in the social networking world. Mobile applications give social networking site users the ability to access the site anywhere, anytime. Cell phone companies are aware of this trend, and have started to created cell phones that cater to social networking sites. Older individuals have begun to use social networking sites more frequently. Businesses are starting to use social networking sites to communicate with employees.

Social networking sites can generate revenue by partnering with other companies. For example, Facebook recently partnered with smartphone manufacturer HTC to release a line of Facebook branded cell phones. Social networking sites can offer users additional/improved services for fees. Social networking sites like Facebook charge its users $1.00 to send “virtual gifts” to other users.  The popularity of social networking sites has made it relatively easy for them to attract investors. If a social networking site is desperate, it can sell its user information to outside sources.

Like YouTube, a lot of copywrite materials is being shared through social networking sites. Who is responsible and accountable to insure that laws are followed? If a piece of copywrite video is shared on Facebook, and criminal charges and fines are the appropriate response, who pays? Is it Facebook's responsibility, the user's responsibility, or both? What about all the other people that shared the link after that?

The US government does not change as quickly as technology.  Social networking sites have been around for a while; however, there are only a handful of laws and regulations that pertain to them.  Under Section 512(c) of the Digital Millenium Copyright Act, social networking sites are not responsible for copyright infringement as long as they have a way for copyright owners to request removal (http://articles.technology.findlaw.com/2007/Sep/18/10966.html).  Section 230 of the Communications Decency Act says that social networking sites are not responsible for the information provided by its users.

This got me thinking - don’t social networking sites all have some kind of disclosure users agree to when they sign up?  Doesn't this disclosure protect them from responsibility?  I think social networking sites should only be help accountable for the actions of their users when they know they are doing something wrong and don't do anything.  For example, facebook has a way of reporting indecent posts, information, etc.  Facebook should only be held accountable if a user reports this type of post to facebook, and facebook does nothing.  Anyone else have an opinion?

Emily,

Good question.  I agree with you on this.  Yes, disclosures are needed to eliminate the liability for social networking sites.  These sites do though have legal and social responsibilities to ensure posts are legal and clean.  I know 13 is the minimum age for Facebook users.  This is a very young age for these kids to be able to communicate with anyone.  Facebook is good at keeping pages clean and eliminating any indecient posts or pictures.  With Facebook allowing these young customers, they must hold themselves accountable to maintain a clean, friendly envirnoment for all users to enjoy.

I also agree with both of you, without those disclosures Facebook would be creating a huge liability for themselves- even bigger than I'm sure they already do. I also agree with you Tim in that 13 is a very young age- I know that Facebook strives to keep its social networking site as clean as possible but at what point do the parents have to take some liability for their own children? When I think of a 13 year old having a Facebook I don't think "wow I can't believe Facebooks allows them to be part of their social networking site" I think to myself "wow, I can't believe their parents allow them to be part of a social netowrking site at such a roung age." At some point we as humans need to take responsibility for our own actions.
